I hired an attorney in March 2012 for a relocation, contempt of both child support and insurance and to extend an OP. Before the OP fell off I told my attorney that she needed to fill an emergency extension to the order to be put in place until the court date. This was all done in Crossville, Tennessee. She said the extension wasn't needed. Long story short. Went to court June 19, 2012. Attorney showed up looking like she rolled out of bed, started off with the OP, judge said he can't extend what doesn't exist. She had no clue why we were there, kept saying um,um,um, didn't have paperwork properly prepared and didn't speak for me at all. My ex ended up running the court going on about things that had nothing to do with the case and lieing about everything else. Not once did she speak up. Judge let my ex off not in contempt, lowering his arrears payment and giving him everything he wanted. Judge never spoke to me. Attorney pulled me aside, mention this may cost more and left. No figure was given. A week and a half later I'm told by her secretary that before (what the judge and my ex agreed on) paperwork will be drawn up and put before the judge for his signature that I have to pay an additional $600. Is there anything I can do? Is she not in the wrong for not even properly defending me as a client or doing what I originally paid her for? Also all of my original fees were paid in full, up front.

I wish to inform you that you may request your attorney for a detailed bill. You may study the bill for anomalies. Thereafter, you may issue a written notice to your attorney pointing out the disputes in the costs and referring to the deficiency in service. If the attorney does not resolve the matter, you may file a lawsuit. The burden of proof will be on you to prove the claims and allegations made by you in the court. The court will consider all the facts and decide the matter. Alternatively, you may file a complaint against the attorney in the bar council of which the attorney is a member. The bar council will investigate the complaint.

I will do what you have suggested. I know that I didn't call or go into the office (unless I was taking them paperwork) so there shouldn't be time charged. I know that most of the work they should have done I did my self. And some of the things they should have done, weren't done at all. But I am curious, can they basically hold the paperwork hostage until they receive the money? And can the detailed bill show what this new amount is for? I know that making a few changes to the paperwork isn't worth three more hours of work. It's more like thirty minutes. I guess like most people I'm going to ask, is it better to just pay it?

Asked the attorney for both a detailed bill and which board she is certified through and I was told that she put a lot of hours in on my case, that I must be the type of person that is never satisfied and that she is going to do only the basics on the paperwork, not add anything that I originally asked for and said that once she gets it done.and mailed to me that she's done with me! Any suggestions? I don't think I'm going to get the detailed statement or who she's certified through.
