Default Lawyers responsibility... We only acted as she advised.

The police called to say there was a summons for my son. I called my PD because the charge with my son is associated with a current issue I have in another court.
She advised me to ignore it, that it could be served by mail, now there is a warrant for my son failure to show up in court. Have not yet been able to speak with lawyer.
Is she responsible? We only acted as she advised. I would like to know before I speak with her/ urgent!!

I wish to inform you that your PD can be held liable for professional negligence because issuing of summons is a clear symbol that your son can be served with warrant if summons are not followed. The burden will be on you to show that you were incorrectly informed by PD. You can file a complaint with Bar Association.

Yes, his public defender was so wrong to gell him to avoid the summons. If you cannot reach her, speak with her boss and make sure that between the two of them they straighten it out with the court!

You do have grounds to file a bar complaint.

I've never heard of the police calling to say there was a summons. Are you sure they didn't serve your son and he didn't tell you about it?

OK thanks! turns out I misunderstod her. She is however contacting the court to tell them it was a simple misunderstanding and that the warrant would be quashed as no one is avoiding the issue. Yes the police did call, I don't know why.
once looking for my son to serve the summons,again to tell us of the warrant???
so we called the court and they had no date set, so we just thought they were trying to get him there to arrest him. I have been lied to by the police in the past regarding similar issues. I would not be able to post bail until 6/1. The issue at hand is a nut job of a neighbor who has proven to local police her complaints are baseless. So, she just went to another agency. This will be explianed to them by our Police and the lawyer. I have been under attack since last summer. I have cameras watching me 24/7 and they will pressure us into re-acting. my son is younger and they realized he will react quicker. Well the police know after so many calls and no proof of us doing anything, they saw it was just a nut job, survieling my every move! In fact we are due in court soon over me walking my dog and . stepping on his property. there are no fences here and no one is real sure of boundries.
He was told to do a survey and will not comply. I saw a cop stand in thier house one nite 3 hours! being curtious to them, ???? There is something so wrong with these people, 9 cams/ 6 no tresspass ing signs all over the house. we are in a quiet place here with many homes around.
I just wonder how much more I can take!! Thanks guys!!
