Hot check? I recieved a cash advance loan online...

Im in a situation where I recieved a cash advance loan online through a wire on my bank account and I didnt have enough funds in my account to pay it back and my bank acccount was closed.

I never did get around to paying back to loan.

I now have an attourney contacting me with a case of some sort of "missappropriation of funds"

I want to pay this back ASAP but he demanded that I pay it back within 3 days of speaking to him. He also made me feel like some horrible criminial who did this on purpose. let me tell you Im not..

the amount i need to pay is 562.00.

I told him id be able to pay half and then the rest of it in two weeks. he said that wasnt going to cut it.

my question is...what are my rights? am i allowed 30 days? this is the first contact attempt ive recieved in almost 9 months since i did it. are they gunna throw me in jail? or is he just trying to scare me to get the money sooner?

It is normally only a civil matter not a criminal one--unless you engaged in some kind of fraud like taking the funds and closing immediately with intent to steal etc.

If it is civil they have to sue and may not do so for such a small amount.

It it considered a felony if the check is under a hundred dollars. Take into account, this happened in 1984.

A cash advance through a payday loan firm is not the same as writing a bad check. It is a loan.
