Question NYS: Would this be legal malpractice?

An attorney handled a lawsuit for an elderly couple.


When it came time for that couple to receive their settlement check, that same attorney -- this time, under the employ of the couple's sons -- conned the couple into giving control of the settlement monies to their sons.


Ultimately, the sons promoted the premature deaths of their elderly parents, so as to take the money for themselves.


The criminal aspect is being investigated, but


>> can the estate of the elderly couple sue the attorney for his corrupt behavior, legal malpractice?
