Default NYS: Is this legal malpractice, or should I take him to small claims?

Should I go after this "creep" via a legal malpractice or small claims lawsuit?

In March 2006, I hired an attorney [the "creep"] to help me in a Section 81 involving an elderly relative.


The attorney never showed me the petition or the court evaluator's report, both of which made my hair stand up, when I first saw them this spring. That's because the documents confirmed that the Section 81 was entirely based on lies and false information.


The attorney had the nerve to bill me $7500 for doing nothing.


I suspect he was part of the "game," in which a hospital tried to take control of the elderly relative's assets.

May G-d help us all who think we can rely on attys for anything. I suppose we have no recourse. I have yet to find but two decent attys in this whole world who do not take advantage of anyone. It is the hard to say "May G-d have mercy on their souls" but we all fall so short but I wil say this, I would never take advantage of someone intentionally. Unfortunately, some take adavntage of this. I am sorry you were cheated. I have been too but G-d is going to give them what they deserve.
