Secretary in DA's office made web postings
I was involved in a bad check case. A woman stold a check book from me and issued herself dozens of chacks to cash. Since the checks were on my account and had my name scribbled in the signature section, I was arrested. I proved through handwriting experts (twice) that the checks werent written by me and they already had proof that the checks werent cashed by me. So my attorney moved to have the case dismissed. The lawyer laid in very hard to one of the DAs (brought up the Nifong case etc) since they had proof that I wasnt involved from day one and continued to not only prosecute. I was able to show that I wasnt even in the country when the checks were cashed. My lawyer stated that she believed that I would have an excellent case against the DAs office.
Instead of dismissing the case, a secretary at the DAs office wrote a letter (on DA letterhead) claiming that I had an extensive record (I had never even had a speeding ticket), that I was wanted for crimes all across the country, that I was wanted by Interpol, that I was a con artist and that no one should even consider working with me or doing business with me. This was sent to several web sites, the police in the town where I lived at the time (about two hours from the county where the case was being tried), the local media, and posted on web sites. The letter went through town like wildfire. I was called a criminal and master con atrist by the local media who referenced the letter from the DA. We were asked to leave our church, couldnt get an appointment at our family doctors, parents stopped letting their kids play over and worse my business folded like a house of cards. I was filing bankruptcy 3 months later.
I tried to get the DA to remove it and he claimed that someone was just using the secretarys name and that she wouldnt do that sort of thing. In discovery however we found that she had issued it and had called my ex husband (who tried to use my criminal background as documented by the DAs letter to avoid child support), my kids school, sent copies of her letter to employment agencies, my bank etc etc etc. She had also given personal details (banking, medical, address to other non-law enforcement people and asked them to "find anything that you can on this woman, i want to see she doesn ten years"). When confronted, the DA said that the secretary had always been a bit of a vigelante but that he didnt consider what she did inappropriate.
Finally my case has been dismissed, but I am now sitting on welfare. I cant get a job in my community and I cant afford to move. Is there anything that I can do to get rid of this? Surely a secretary cant use DA letterhead in order to harass and slander someone. Any ideas on a next step?
