2 Years and still waiting for a Court Date
We sold a Superette in January 2006. A deposit was paid, and the people wanted to run the shop until their money came through from the husbands pensions fund. I agreed on a pro-rata profit basis. They get 25% and we get 75% of the profits. 2 months down the line, these people either had a lot of debt or were dishonest. They took R25000 lotto money which they put in their pockets and were unable to pay rent for the shop for 2 months. End of April 2006 they "walked away". When I went to take back the shop, they had walked away, but emptied the shop of R100 000 worth of Stock. I have a signed sales agreement with all the terms. My lawyer after spending 2 months looking for these people served summons on them in August. One for balance of payment. two, for damages of R80 000. ie unpaid rent, lotto, and telephone etc. It is now May 2008, and I have not had ONE phone call from my lawyer to advise the status of our case. I have now been trying to talk to him for about 8 months, and he never ever returns my calls. What can I do, to find out what the situation is re a court date. We are people who are due to go on pension in 2 years time. We have basically lost everything, and have now resorted to selling our furniture to live. We are desperate and dont know our rights.
