What is the proper way to go about setting up a legally binding contract in which the party who claims confidentiality adheres to it or suffers the full extent of the law? Is it best to have the document notarized if this document must be down via mail, verses face to face?

Signed agreements with reasonable penalties are binding...so have both agree and then sign.
