Confused seizure during an eviction

My brother was convicted of a felony Aug. of last year.
Last week a handgun is found under his mattress by the moving company and was given to the sheriff who was there to witness the eviction.
My brother was not present at this time his belongings were being moved by the moving company. He is now being charged for possession of an illegal firearm. Was it legal for the item to be confiscated?

Also other things were taken. Things that would not have been in plain sight.
