Exclamation Shoplifting: Do I have to pay the civil claim fine I was told I would be mailed?

I am a 22 year old female and I was caught shoplifting several cosmetic items from a Shoppers Drug Mart store. My picture was taken by the LP officer and I was served with papers stating that I was banned from that particular Shoppers location, as well as the fact that Shoppers would be making a civil claim against me to recover the cost of the items and for damages. I was told that if I did not pay the fine I would be taken to court. In addition, the police were called however, I was not arrested by the police officer, she only took down my name, address and phone number. I had been cooperative so the LP officer had recommended that I not be arrested and have criminal charges brought against me.

I have 2 questions:

The first being: Will the fact that the police officer was called and took down my information mean that the offense will be on my criminal record?

And secondly: What obligation do I have to pay the civil claim fine being brought against me by the store? If I do not pay it what is the likelihood that they will take me to court?

This was my first shoplifting offense ever and I am a university student who does not have a lot of money. My actions were extremely out of character and I deeply shocked, upset and remorseful about what I did. I am currently receiving treatment and psychological therapy for depression and an anxiety disorder and have been taking some powerful medication. I have not felt like myself lately and have done other things that are also out of character. I feel that my theft of the items from Shoppers Drug Mart is related to my current medical condition.

Any advice on my situation that you could offer me would be much appreciated.

I wish to inform you that as no charges have been filed against you, therefore, you are not guilty of any criminal offence and so nothing will be stated in your criminal record. Shoppers Drug Mart can demand just the amount of their loss and damages in a civil matter. If you do not resolve the matter, Shoppers Drug Mart can take action both for criminal action for theft and civil action.

Regarding criminal charges, depending on what the law allows, you will probably end up with a ticket or citation for the shoplifting charge, a notice to appear before a judge, or in some cases, no charges would actually be filed against you.

As for the civil demand, this is something that occurs IN ADDITION to any potential criminal penalty. The law allows for a civil penalty (which is usually around $250), and this demand applies regardless of whether or not criminal charges were ever filed, whether or not you are convicted of a crime, regardless of the value of the stolen items, and regardless of whether or not the items were returned. If you do not pay the civil demand, the retailer can sue you to recover this amount from you. If a judgment is issued against you, then this will affect your credit for years to come.

You have a criminal once you have been to court and a verdict of guiult or innocence has beenissued. There "might" be an arrest or Police record of this but it likely will not come up in typical background search.

And secondly: What obligation do I have to pay the civil claim fine being brought against me by the store? If I do not pay it what is the likelihood that they will take me to court?

How agressive they are about seeking the Civil Demand depends on the retailer and the law firm issuing it. Palmer and reifler are very very agressive. There can also consequences for not paying that can impact you for years to come. Its probably best to pay it

Hi, the exact same thing happened to me, every word of your story is true to me. Was wondering if you paid the fine, if i should pay it, and was it a location in toronto?

I have exactly same problem with her but police asked me sign to the paper to admit my wrong doing and he add me to CRB system , unfortunately I signed on that day... I will apply my new visa next month... Am in Tier 1( psw visa at the moment) ... Is there any bad effect for my application and what should I do now... Help me please, it so urgent! Many thanks! ( I am living in Uk under Tier 1 now)

It appears we know what your special tier 1 talent is. How much did you steal? What charge/caution did you sign a confession of guilt to?

That's stupid thing I did. I am in Tier 1- post study work visa. The item cost about 10. Now I know it can destroy my future . The police gave me paper write down that " I admit to steal items in the shop. And I signed in it. Also I signed in the paper said that they will add me to CRB system. But he told me that it's not conviction or criminal record. Just record my wrongdoing and I can't apply for special job such as police, child care... That's it it. I went back to my home at the moment. When I come back UK next 2 week, will they stop me at the airport and could I still be sponsored to apply for my visa next few weeks.... Please give me best advice... I am desperate now

A single caution should not affect your tier 1 immigration status. Note a second might.
