Can I sue an exboyfriend for statutory rape if I was 16 and he was 22 when I got pregnant and werent married at that time? We got married over 2 years after

I wish to inform you that laws of your state will determine your rights. In this regard generally if an offence has been committed and if the ingredients of Statutory Rape as per your state law has been committed then the accused can be held liable for statutory rape. Marriage has been performed after two years which makes person liable on the day of commission of offence. When statutory rape was committed at that time there being no marriage offence has been committed.

It is unlikely that a court would entertain such a case since you later married. What would be the purpose of the suit? Statutory rape is a criminal offense. While a civil suit may be brought for the effect of a crime on a person, there has to be proven damages.

Having married him two years later, you would have a lot of explaining to do as to your reason for bringing the suit now and also some legal and actual basis to claim civil damages.

Thank you. 2 years after we married I decided to leave him becuase there was domestic violence he was on drugs and we had joint custody of our child but a few months later he asked for the whole custody and was granted it (my attorney withheld a lot of stuff) and then I fleed with my baby.
