car serched found nothing arrested for dui 2 wks later car searched find drugs

i got arrested for dui my car gets searched the cops find nothin my car gets towed away. 2 weeks later i get realeased from jail try 2 get my car from impound officer says they found drug perifenelia under the passenger seat where my friend was sitting can they add a drug charged if when they searched the car the first time they found nothing??

I wish to inform you that you may argue in this case that when search was conducted the at that time no drug paraphernalia was found. Further when police informed you that later drug paraphernalia was found at that time you were not present and in absence of your presence it raises a suspicion as to the source of drug paraphernalia. You may argue that as at initial search nothing was found therefore you should not be liable for anything found during search in your absence and in the custody of police. Further search by not following rules regarding search may violate your rights under natural justice.
