My relative is awaiting a trial for sexual assault and theft and he has hiv/aids and hepatitis c and is contagious. What are the laws on prisoner releases?

The Alabama Department of Corrections recently announced the end of its long standing ban of prisoners who are HIV positive from participating in the state's work release program, after nearly two decades of intense lobbying by the American Civil Liberties Union.

The ACLU and other organizations have long cautioned state officials that the ban was an arbitrary and discriminatory denial to participation in such programs, which are essential for aiding a successful reintegration into society for prisoners.

Locations at which HIV-infected prisoners are now eligible to join work-release programs are Tutwiler Prison for Women in Wetumpka and Limestone Correctional Facility in Harvest -- which houses separate units for prisoners who are infected with the deadly virus.

Alabama prisons have now changed their work release policies

After years actively discriminating against prisoners with HIV, Alabama prisons have now changed their work release policies. HIV positive offenders are now eligible for these valuable programs. South Carolina is apparently alone among the 50 states in banning inmates with HIV from going on work release.

This is a big deal for HIV positive inmates in Bama. Work release ia an important and highly valued opportunity for prisoners. Participants are often housed in stepped down security situations. They are able to earn a bit of money (some of which can even defray the costs of incarceration.) And the program can ease offenders transition back into society. That is, work release programs can help reduce the risk of recidivsm.

If you mean will the jail release him for that reason alone, the answer is normally no. But if he is so sick that they don't want to foot the bill, there is a chance that some kind of supervision could be put in place and the person allowed to be at home, with some outside medical care presumably.

Get a lawyer to help you review all the options.
