Default Dropped Assault charges in Canada

I had assault charged dropped against me, however I am now in a one year peace bond.

I was wondering if I can seek punitive (or similar) damages against the plaintiff for filing these charges. Which has caused me and my family great humiliation and trauma. My 5 year old daughter and I were forced out of my home (because I had to leave the home, not him "the victim" - a member of the Canadian Armed Forces btw), causing me to seek another home for us in only 2 weeks (damage deposit, rent), retain a lawyer ($1500), my friends and family had to pack up my own home and belongings and the whole situation gave my mother a minor heart attack!

It is unbelievable to me that a person can manipulate a system that is in place to PROTECT those that truly need it and get no punishment for it. He wanted me out of the house and find a weaselly way to do it. Agreed, "assault is assault", but there must be a line drawn somewhere!

My charges were dropped, obviously I was not a serious case, but now I still must suffer through a ridiculous peace bond. I have never been in trouble my entire 30 years of living.

Is there anything I can do? or am I supposed to just suck it up and be thankful I don't have a criminal record? He tried to ruin my life for nothing and almost got away with it. Something should be done.

Sorry for all you've been through. If you could prove malice on his part you might be able to sue. But, to be honest, you can almost be guaranteed nothing will come of it due to immunity for reporting abuse. If you're in Canada, ask WLD through their main page. They have lawyers there who could help and let you know for sure. AJJ

You being charged looks good on you. I wish more police officers took women assaulting men more seriously like this one did. Like you said "assault is assault" and no matter sex, age, size, or how violent; it is what it is and thats ASSAULT.

And the answer to your question is NO and the reason being is that this isn't the USA.

Did you plead guilty or not guilty to have the charges dropped and the peace bond put into place?
