Default restitution of stolen property

Scenario is...John, Stan and Dave broke into an auto garage. They stole many parts from the garage and a car in the garage. They were caught about a month later. ALL stolen parts were returned to the victim/garage owner. John and Stan worked a joint deal with the victim/garage owner and the local D.A to work 160 hours for the victim inorder to pay for damage and stolen items. Dave had no communication with the victim/garage owner but paid $6200 in restitution. John and Stan completed their 160 hours. The D.A. dropped the case against John and Stan.

my questions are,(1) if the shop owner did not list some of the stolen parts on the inventory he gave the police, are John and Stan required to buy those parts or is it the garage owners responsibility? (2) shouldnt the money that daved paid the victim go towards any unaccounted for stolen items? (3)Can the owner of the car file charges against Stan and John for stolen parts after the D.A. has dropped the case.

That is all purely what you negotiate and agree.

And civil suits can still be filed for any losses that exist after restitution.

but can the car owner file criminal charges? or just civil?
