Default Tape of conversation: A person arrested on the charges of taking bribe.

A person arrested on the charges of taking bribe. But as per the documentary records work were already done for which the complain has been lodged. Demand of bribe not proved. Procicution have a recorded convertation at the time of transiction of money but same not seized in presence of accused. Copy not given to accused. Whether the recorded conversation valid?

The recorded conversation is generally legal. But you do get a copy. Have your lawyer file to collect all evidence of the prosecution.

For your info, see also "taping phone calls" on the main site:

WORLDLawDirect - Taping phone calls

If you can't tape calls then you normally cannot tape conversations--if you can tape calls then check with your State Attorney General for the laws regarding in-person conversation.

Law enforcement does have other rights to tape if they have reasonable cause.
