Angry Criminal possession of stolen property...

I had borrowed money from a "friend" and given him my ATV as
collateral. Before I could pay back the money he stopped answering my calls and sold my ATV. I went to the police and they said they wouldn't touch the
situation, however I've looked at many websites that said this is a felony so why won't they go after him?? This was 2 years ago and I'm still making payments on the ATV, I don't even have a title for it!! But it was okay for him to sell it?!?! What can I do???

Default Re: Criminal possession of stolen property...

The police likely see that as a loan transaction and a business dispute--Based on what you say here, you could file suit against him (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to his behavior...

Cool Re: Criminal possession of stolen property...

Not a lawyer, but my first question is got any paperwork? Did you sign any agreement about the money you borrowed? there should have been a pawn certificate. (EX:if I don't pay by --- then you get to keep ---) some sort of paperwork is needed otherwise it's your word against his. Personally, (remember I'm no Lawyer)If I didn't want to go small claims court, and I had no paperwork showing my signiture agreeing to any pawn arrangement, I would quit paying payments and tell the loan company where it was last parked and let them go get it, I'd tell them the guy sold it without my consent. They want their money they'll go get it. But of course this could put a small damper on your credit report, but if you have paid for two years, without missing any payments or being late on payments, it should just be a small damper not too bad or at least in my opinion not as bad as paying for something somebody else has. But of course opinions are like behinds, everybody's got one and some are better off not seen or heard.
{In my experience: money + friends = disaster to friendship}
