Default Elder Law Attorneys

Elder Law is a relatively new specialized field of law that deals with the issues faced by the fastest growing segment of the U.S. population, the elderly. This area of law combines elements of Estate Planning, Wills and Trusts, Conservatorship (also called Guardianship), Health Care Planning, Medicare/Medicaid Planning, and Elder Rights.

The three major categories that make up Elder Law are:
  • Estate planning and administration, including tax questions;
  • Medicaid, disability and other long-term care issues; and
  • Guardianship, conservatorship and commitment matters, including fiduciary administration.

Other issues found under the umbrella of Elder Law include such areas as estate planning; wills; trusts; guardianships; protection against elder abuse, neglect, and fraud; end-of-life planning; all levels of disability and medical care; retirement planning; Social Security benefits; Medicare and Medicaid coverage; Medicaid planning (United States); consumer protection; nursing homes and in-home care; powers of attorney; physicians' or medical care directives, declarations and powers of attorney; landlord/tenant needs; real estate and mortgage assistance; various levels of advice, counseling and advocacy of rights; tax issues; and discrimination.

A new level of consciousness about elder abuse is giving rise to lawyers who assist in protecting seniors.

Confused Re: Elder Law Attorneys

My brother is applying for guardianship of my mother and my sister and I would perfer that he is not. We have gone to court twice now, and still nothing has been resolved.

It's attorney has just fine a letter stating because my sister and I have responded, that the judge should move forward and appoint him. Back in Feb the nursing home where my mother resides gave my brother an evication notice for nonpayment, however, they requested a state hearing. According to the laws it's very difficult to remove a resident from the nursing home, when the family doesn't want them moved.

In the past my brother has tried to block me and my sister from visiting or taking her out for a ride....this brother has been a royal pain in the xxx....any suggestions for me

The judge will usually see what has been going on.

Document the history of all of this as carefully as you can.

And provide a good summary for the judge as well.

I have, however, my brother hired an attorney and the last time we went to court the judge was tee, hee with his attorney.
