Default Civil Rights Law

A civil right is an enforceable right or privilege, which if interfered with by another gives rise to an action for injury. Examples of civil rights are freedom of speech, press, and assembly; the right to vote; freedom from involuntary servitude; and the right to equality in public places. Discrimination occurs when the civil rights of an individual are denied or interfered with because of their membership in a particular group or class. Statutes have been enacted to prevent discrimination based on a person's race, sex, religion, age, previous condition of servitude, physical limitation, national origin, and in some instances sexual preference.

United States

The judiciary, most notably the Supreme Court, plays a crucial role in interpreting the extent of the civil rights. A single Supreme Court ruling can change the very nature of a right throughout the entire country. Supreme Court decisions can also affect the manner in which Congress enacts civil rights legislation, as occurred with the Civil Rights Act of 1964. The federal courts were/are crucial in mandating and supervising school desegregation programs and other programs established to rectify state or local discrimination.

State constitutions, statutes and municipal ordinances provide further protection of civil rights.

International agreement on civil rights

The existence of civil rights and liberties are recognized internationally by numerous agreements and declarations. Often these rights are included in agreements in which nations pledge themselves to the general protection of Human Rights. The United States has recently adhered to the most notable international agreement on civil rights: The International Covenant on Civil and Political Rights.

hi; i borrowed money from a friend , but we signed a legal agreement to repay her with interest. however things didnt go according to plan and i was early disembark from my job due to pregnancy. i am unemployed and have about 6-9weeks before baby is born. I dont have any fixed income to pay her on a monthly basis. I will only be in this position hopefully once i find a job which would be around september of this year. what can I do? what is the ladies position in terms of my current state if she wants to take legal action against me?

I wish to inform you that the legal position is same. If you have taken a loan then your friend who ids your creditor can go for your assets to settle debt if there is default. If you will not pay the amount then you can be held liable for default. You can enter into modification of your loan agreement in which you can agree to pay when you have got a job in September. You can discuss with your friend legal cost which your friend has to incur in case of breach of agreement and this may enable your friend to agree for modification.

Well the balance i owe is about R14000,00 and I do not have assests to the value of that. I cannot guarantee employment either as jobs are scares in south africa. Secondly I honestly dont have a fixed income at the moment. Its not that i dont want to pay, only unforeseen circumstances lead to my financial position. I have a car but the value is way more then that, can she take that from me, for such a small amount? As far as i know personal loans dont have security as a bond or car loan to stand as security. I need my car, and given my pregnancy and in some jobs you need own transport. i have text this lady to advise her on my position but it just seems like she doesnt understand probably.

hi, when your debt is written off due to unemployment, how can one fix that for future purposes to apply for a mortgage bond. how long does it affect your credit profile?
