Hi I am 17 years old as well as my girlfriend. We live in Alabama and she is treated like **** where she currently lives. I want to know all of the required documents as well as procedures necessary for us to get married. She is in foster care and I am no longer allowed at the foster parent's property. we have access to her birth cert. and social security card

I wish to inform you that the laws of the state will determine your rights to marry. In case of Alabama you will require parents consent if you intend to marry with the girl. Further you may obtain marriage licence. Validity of marriage licence is 30 days.

Under the age of 18 in Alabama, both parents' consent is necessary along with a copy of birth certificate, driver's license, social security number and/or passport if no driver's license. There is no waiting period and one need not be a resident, but under the age of 18 parental consent is required.

Thanks for the replies! I did specify that she is in DHR's possession. If she is not allowed to see or contact her parents in any way (We have secretly done so however) can they still be the ones to sign for her marriage? I know for a fact that her foster parents will not cooperate as they now hate me.

Since she is 17, it is not long to wait until she is legally able to marry. The State I doubt would give permission. Her foster parents will not. So waiting is her only option. Or applying to DSHS to be placed elsewhere, for cause. And she should state her case, loud and clear plus put in writing.

I am in a similar situation. I am 20, and my girlfriend just turned 18. Her father has been charged with a sexual abuse charge on one of her adopted sisters and because of this all of the underage women have been removed from the house. This happened when she was 17 (back in December 2011) and currently the state will not allow her to move back in with her parents or with any family member even though she is 18. The legal age in Alabama (like Kentucky; the only other state) is 19. She cannot marry me unless she is declared a legal adult by court in June, neither can she move out of temporary guardians house. I think that once someone is 18, they should be able to do as they please, that includes marriage. But I am also interested if she needs consent from foster care at this time.

In the state of Alabama the legal age to get married without parental consent is 18 not 19. The only state that requires you to be 19 is Nebraska. The parents of the minor from the original post cant give consent for her to marry as she is not in their care anymore. She will have to have consent from the foster parents whom are her legal guardians and even then has to go thru the court system for a judges approval. The amount of time it will take you to do all this will be about the same amount of time it will take for her to turn 18. Be patient because if the two of you truly love each other and are meant to be it will happen in time. She doesnt need to rush into marriage as a way to get out. If this is her reasoning it wont last, I have been there.

Okay I also am in a situation similar. I'm seventeen and my aunt has legal custody of me. She's willing to sign for my marriage and my biological mother is also. My only issue is that my dads no longer part of my life and since my legal guardian is signing for me to get married does that mean that I can legally move out without her permission since I will be married? I live in Alabama btw.

Marrying at the age of 17 is not a wise thing to do. The chances of the marriage working out are better than 90% against?
Marrying to escape another living situation is jumping from the frying pan into the fire. It will cause many life changes no 17-year old is suited to face. |
