Confused Confused on laws in Texas

My niece has been living with me for 2.5 months. Her mother has only
contacted her 1 time the whole time she has been with me and that was
because her brother was in a car accident and mom picked her up to go to the hospital to see him. She then had someone bring her back to my home. While my niece lived with her mother, she started drinking, staying out all night due to a lack of respect she has for her mother. Her mother has openly cheated on her father AND is very known as being a habitual liar. Her mother has also told her repeatedly, I should have had an abortion instead of having you because all the problems came after she was born. (My niece is African American while her mom and dad are Hispanic) and she has now flunked 9th grade 3 times. Today, the first day of school, she found out she was not registered at the school, (her sister called 3 weeks ago to tell her that mom had registered her)and called me. She is being threatened now (just today) that she has to go home. She is miserable at her mom's home and wants to be emancipated. How does she go about it and what are the requirements? She is 16 now and I am scared if forced to go back home, she will go back to her old ways. I have left many messages for her mom to call me in the last 2.5 months and mom will not call me back. No support has been paid for her care and I even bought her school clothes. I am not interested in the money just want the best for my niece and I don't know what options we have. Is she considered abandoned? Please help!

You may want to contact social services and see if they can become involved, or give counsel.

It would be hard to go to court and win over the bio mother unless you can show circumstances are very, very bad and the court should take custody away from the mom.
