Default Fathers Parental Rights terminated illegally (incorrect jurisdiction)

my kids were taking into custody by children youth service, i was told by the worker that i had to complete the information that they request in order to get my children back. i went to all court dates and i visit my kids while they were in foster care, they were placed in to different homes but i still went to see my children, at one of the court dates the CYS worker told the police that i had a warrant in another county they arrested me at the hearing for my children, CYS said i had to do everything they had on paper in order to get them back including clearing up all warrants, well i had to do 2 years in jail for the warrants and CYS said that i could still see my kids and i still had to do what was on their list. which i did some of them while i was in jail. they wouldn't bring my kids to see me the worker said it was to far for them to bring my 3 children, i was in Delaware county jail and my kids were in bucks county in Philly. the case worker wouldn't give me any help with my kids because we lived in Philadelphia and they had my kids in bucks county. the social worker kept saying that i had to move to bucks county for them to help us but i couldn't afford to move, i called Philadelphia CYS and they said that they couldn't help me because my kids were in custody in bucks county and that i had to have my case transferred there but bucks county social worker wouldn't transfer my case to where i lived which was in Philadelphia. i saw on the record that my kids were adopted and was told that my parental rights were taking but i never got a letter stating that and the soical worker never gave me a chance to complete what she had on the paper for me to do. i also read that they are trying to get my case dismissed because i was incarcerated in the state of florida which was a lie i was in Philadelphia for my whole 2 years that i did. i feel that my rights were terminated illegally and i really need a lawyer to help me get my kids back please!

I wish to inform you that you can have your kids back. In this regard you can argue in court that your parent rights were terminated without providing you any opportunity. Every person has a right to represent and thus your lack of information caused termination of your rights. Court will consider best interest of child as main consideration and thus you may show that incorrect termination has affected interest of child. The place where the child resides will have the jurisdiction. Thus if children were earlier living in Delaware then court of Delaware will have jurisdiction and you may object court order based upon incorrect jurisdiction.

At some point a judge decided it was in your childrens best interest to be adopted.

You can certainly hire an attorney to try and sort this all out but I suspect you will not be successful in having your children returned to you.

The courts do not need your permission to terminate your parental rights.

What happened with mom? Did she give the kids up?

She gave up Her rights , and they were terminated according to court document, but it doesn't state that mine were.

Check with the court that has jurisdiction. If your rights were not terminated you can petition for custody/visitation.
