Default adoption rights for father of unborn child

I have a niece who wants to put her unborn child up for adoption. The biological father will not sign any papers releasing his rights. He is on drugs now and could soon go to jail as he has a hearing coming up for possession of drugs. They both live in Pennsylvania. Can she proceed without his consent.? If not, she wants to have an abortion but she is getting far along in her preganancy. Can he stop her. Please advise.

I wish to inform you that in case unwed parents the child can be given for adoption without the consent of father. In this regard after child is born if father does not establish paternity then other can give child in adoption without fathers consent. Further if father establishes paternity then court order terminating paternal rights will be required before giving child for adoption. As the biological father is on drugs thus he may not take care of child and his paternal rights may be terminated.

If they are wedded couple consent of father is mandatory to put the child for adoption. There are some papers which require the signature of the father. Unfitness of a father is not a reason to avoid his consent.
