Unhappy Is adoption possible

I am married. I have 2 children. 1 w/my husband and one from a previous relationship. My husband wants to adopt the child that is from the previous relationship and I agreed because the child's biological father refuses to pay child support (avoids being served with the support order hearing papers) and does not do anything for my child even as far as a relationship between them. I feel that my child has a great father figure in my husband (who has done more for her financially and relationship wise in 3 yrs than the biological father has in child's entire life) and should be able to receive the full benefits of this relationship and live a happy life. I want the best for my child. Would the biological father have to give up his parental rights in order for my husband to adopt my child? Is this the only way?

Normally yes that has to occur. But if you get aggressive on support collection and he realizes that he would no longer have to pay support, he may agree.
