Can my sister adopt my daughter

I left my husband in July 2008. In August 2008 he filed for divorce and sole custody of our daughter. We reconciled our differences and he told me that he would stop the divorce and the custody. He did stop the divorce but did not stop the custody and did not tell me until after it was all said and done. Which did not give me the opportunity to make my case.
Now he is trying to take my daughter and leave. She does not want to be with him. She has begged and begged for him to leave her with me if he leaves and he wont. My sister whom we live with wants to adopt our daughter. How do I or her go about getting this done. She is in the military and can better care for her than he can.

How did that happen?

You cannot get the custody part done without a divorce proceeding unless there is abuse or neglect etc normally?

Is some part missing here?

PS--dad has to approve and agree to any adoption.

he told several lies about me. None of which were true. He made me out to be an evil person and his attorney bought it all.
We now live in Florida but all of this was done in Arkansas will that have any affect on it.
What about my sister fighting him for custody. Can that be done?
We have lived with her since September of last year and he doesnt make enough money to even help her with the bills. I dont work because I take care of her special needs daughter. If he leaves here he will go to his moms house. He wont have a job nor a place of his own to live.
