Confused Termination of Parental Rights and SS death benefits
I will soon be adopting my grandchild. Her mother is deceased (July 2007) and the father's parental rights will be terminated. Currently the DHHS-CPS has taken the child's Social Security death benefits to replenish their funds in support of this child. They are telling me that once parental rights are terminated I will not be eligible to receive these benefits on behalf of the child because both parents parental rights will be terminated. How can they terminate the rights of a deceased parent? Will this be legal ?
